TERMS & CONDITIONS OF HIRE

1. Definitions and interpretation

In these Terms & Conditions:

  • “Company” means Lumen design.
  • “Client” means the person(s), company or entity entering into the hire agreement.
  • “Event Date” means the date(s) specified in the booking confirmation.
  • “Hire Items” means all furniture, garden furniture, glassware, textiles, décor and any other equipment supplied by the Company.
  • “Hire Period” means the period commencing upon delivery and ending upon collection by the Company.
  • “Total Booking Value” means the total amount stated in the accepted quotation, excluding the damage deposit.

These terms are governed by and interpreted in accordance with the laws of Scotland.


Our understanding: These definitions are provided simply to ensure complete clarity and avoid misunderstandings for both parties. 

2. Formation of contract

2.1 A binding contract is formed when:

  • The Client confirms acceptance of the quotation in writing; and
  • The required deposit has been received in cleared funds.


2.2 The Company reserves the right to decline a booking prior to receipt of deposit.


2.3 The accepted quotation, together with these Terms & Conditions, constitutes the entire agreement between the parties.


Our understanding: This ensures your chosen items and date are securely reserved and that everything agreed is clearly documented for peace of mind. 

3. Payment terms

3.1 Bookings made more than 12 months prior to event date 

  • A 25% non-refundable deposit is required to secure the booking.
  • A further 25% instalment is due 6 months prior to the Event Date.
  • The remaining 50% balance is due 4 weeks prior to the Event Date.


3.2 Bookings made within 12 months of the event date

  • A 50% non-refundable deposit is required to secure the booking.
  • The remaining 50% balance is due 4 weeks prior to the Event Date.


3.3 Final payment obligation

  • All outstanding balances must be paid no later than 4 weeks prior to the event date.
  • Time for payment shall be of the essence.
  • Failure to pay by the due date constitutes a material breach of contract and may result in cancellation of services without refund of monies paid.

The staged payment structure reflects advance stock reservation, administrative preparation and loss of alternative booking opportunities.


Our understanding: These staged payments allow us to carefully prepare, allocate and protect your chosen items well in advance of your celebration.  


4. Damage deposit

 4.1 A refundable damage deposit of £200 is required.


4.2 The damage deposit is payable alongside the final balance, 4 weeks prior to the Event Date.


4.3 The deposit will be held as security against:

  • Loss or theft
  • Breakage
  • Damage beyond fair wear and tear
  • Excessive cleaning requirements
  • Failure to return items


4.4 The damage deposit will be refunded within three working days following the event date, subject to full inspection of the Hire Items.


4.5 Where losses exceed £200, the Client remains liable for the full replacement or repair value.


Our understanding: We appreciate that weddings are joyful occasions, and this deposit simply ensures items are returned in the same condition so we can continue providing beautiful pieces to future couples.

5. Delivery, collection and handling

5.1 All hire Items shall be delivered and collected exclusively by the Company. Client collection is not permitted.


5.2 Delivery and collection charges are calculated based on distance, staffing requirements, venue access conditions, installation complexity and waiting time.


5.3 The Client warrants that safe and suitable access will be available, accurate venue information has been provided, and a responsible person will be present to accept delivery.


5.4 Additional charges may apply where access conditions materially differ from those declared at booking.


5.5 The Client assumes full responsibility for the Hire Items from the time of delivery until collection.


Our understanding: Professional delivery protects your hired items and ensures everything arrives safely and beautifully presented on your special day.

6. Hire period and responsibility

6.1 Responsibility for the hire Items transfers to the Client upon delivery.


6.2 Responsibility ends only when the Company has physically collected the items.


6.3 The Client shall ensure the hire Items are protected from weather damage, safely stored overnight where applicable, not left unsecured, and not misused or altered.


6.4 The standard hire period for all Hire Items is 48 hours. This period is designed to allow delivery the day prior to the event date to enable client setup, with collection following the event.


Longer hire periods may be agreed in advance and will be subject to additional charges based on availability, logistics, stock scheduling and operational requirements.


A reduced hire fee for a shorter hire period is not available.


Our understanding: The 48-hour hire period ensures clients have adequate time to prepare and style their event comfortably, while also allowing us to manage logistics responsibly and maintain the quality and availability of our curated items.

7. Use and care of hire items

7.1 All hire Items remain the property of the Company at all times.


7.2 The Client shall not modify, alter or repair items, apply adhesives or fixings, or sub-hire items to third parties. 


Furniture and garden furniture must be protected from extreme weather. Glassware and fragile items will be charged at replacement value if damaged. Textiles damaged by staining, wax, burns, mildew or mould will incur replacement charges where restoration is not possible.


Our understanding: Our items are carefully curated and maintained, and your care ensures they continue looking beautiful for many future celebrations.


8. Loss, damage and cleaning charges

The Client is liable for full replacement cost of items lost, stolen or damaged beyond repair. Excessively soiled items may incur additional cleaning charges.


Our understanding: We always assess fairly and reasonably, and only charge where items cannot be restored to their original standard.

9. Styling services

Styling services are provided at additional cost and are individually quoted based on scale, complexity, venue access, distance and staffing requirements. Styling services must be agreed in writing.


Our understanding: Every wedding is unique, and this approach ensures you receive a tailored styling service that reflects your vision. 

10. Cancellation by the client

10.1 If the Client cancels the booking, written notice must be provided.


10.2 All payments made are non-refundable, as they reflect advance reservation of hire items, preparation, administrative costs and loss of alternative booking opportunities.


10.3 The following cancellation charges apply based on the Event Date:


More than 26 weeks before the Event Date
The initial deposit (25% or 50% depending on booking timing) will be retained.


Between 26 weeks and 12 weeks before the Event Date
A minimum of 50% of the Total Booking Value will remain payable.


Within 12 weeks of the Event Date
Up to 100% of the Total Booking Value may be payable.


 

The Client acknowledges that the staged payment structure reflects advance stock reservation, administrative preparation and the loss of potential alternative bookings.

Our understanding: If cancellation occurs after additional instalments have been paid, all sums already paid will be retained and any outstanding balance required to meet the applicable cancellation charge will become immediately payable.



11. Date changes

If the Client requests a change of event date, Lumen will use reasonable endeavours to accommodate the new date, subject to availability. If the new date is unavailable, the request will be treated as a cancellation under the above terms. 

12. Insurance

The Company maintains appropriate public liability insurance.

The Client is responsible for arranging suitable event insurance to cover loss or damage to hire items during the hire period and event cancellation.


Our understanding: Appropriate insurance provides reassurance and financial protection for everyone involved in your celebration.

13. Photography & marketing usage

The Company reserves the right to photograph hire Items for portfolio and marketing purposes. If the client objects, written notice must be provided prior to the event date.


Our understanding: We use imagery respectfully and professionally, always mindful of the personal nature of weddings.

14. Venue indemnity

The Client is responsible for ensuring compliance with venue rules and warrants that necessary permissions have been obtained. The Client indemnifies the Company against claims or costs arising from venue rule breaches or inaccurate venue information.


Our understanding: This ensures clarity of responsibility so all suppliers can work smoothly within venue guidelines.

15. Supplier access & welfare

The Client shall ensure safe and reasonable working conditions for the Company and its staff, including:

  • Safe access and egress
  • Adequate time for installation and collection
  • Clear working space

For installations exceeding 5 consecutive hours, the Company reserves the right to request reasonable provision of refreshments or meal arrangements.


Our understanding: We are committed to delivering excellent service, and appropriate working conditions allow us to do so safely and professionally.

16. Data protection & GDPR

The Company processes personal data in accordance with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018.

Personal data will be used solely for:

  • Administering bookings
  • Delivering services
  • Fulfilling contractual obligations
  • Marketing communications where consent has been provided

Data will not be shared with third parties except where necessary for service delivery or required by law.


Our understanding: Your privacy and personal information are handled with care, transparency and respect.

17. Limitation of liability

The Company’s total liability shall not exceed the total booking value. Nothing excludes liability for death or personal injury caused by negligence or any liability that cannot be excluded under Scots law.


Our understanding: This clause ensures responsibility is proportionate and clearly defined.

18. Force majeure

The Company shall not be liable for failure to perform obligations due to circumstances beyond reasonable control, including severe weather, government restrictions, road closures or venue denial.


Our understanding: In rare and unforeseen situations, we will always act reasonably and communicate openly.

19. Dispute resolution

The parties agree to attempt good faith resolution of any dispute. If unresolved, mediation will be considered before court proceedings. Scottish courts shall have exclusive jurisdiction.


Our understanding: Our priority is respectful communication and practical resolution wherever possible.


20. Severability

If any provision of these terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.


Our understanding: This ensures the overall agreement remains effective even if one clause is challenged.

21. Acceptance

Payment of the required deposit constitutes full acceptance of these Terms & Conditions.

We are honoured to contribute to your celebration and remain committed to delivering a professional, carefully managed and beautifully executed service.
